HuntingWife is correct; there are no approved tests for CWD in live animals. There are a couple methods that may hold promise for the future, but for now it's postmortem.

In this instance I would think it's pretty clear that the guide didn't have much direct involvement in this hunter's choice to shoot from the road. The hunter knows, or should know, that that is illegal. However, I do agree the guide should have been cited for his/ her actions after the shot.
I can't speak to the landowner lists, but they do have a really good hunt atlas they put out. Some nice walk-in areas too. We hit these up mainly after pheasants once our late season antelope hunt was done, but there were some deer around. I had luck knocking on a couple doors that locals...

Elk hunting in Kentucky has certainly become more challenging... in some areas. Places with a higher presence of guides have definitely seen the most extreme changes, IMO. Try to pick an LEA with more public areas and fewer permits allocated. I'd recommend Middlesboro as my first choice, but...
